These Terms of Service ("Terms") are a binding agreement between you and DEADZONE DOMINION ("we", "us", "our") governing your access to and use of DEADZONE DOMINION, including our game client, servers, and website (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service. The Service is not directed to anyone under 18, and we do not knowingly collect their data. By using the Service you represent that you meet these requirements.
You may play as a device ("guest") account or link an email address and password. You are responsible for your account and for keeping your credentials secure, and for all activity under your account. Notify us at [email protected] of any unauthorized use. We may refuse, suspend, or terminate accounts as described in Section 9.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and play the Service for your own non-commercial entertainment. We reserve all rights not expressly granted.
You agree not to: (a) cheat, exploit bugs, use bots/automation, or manipulate game state or the economy; (b) access the Service through unauthorized means or interfere with its operation or security; (c) reverse engineer except as permitted by law; (d) harass other players or post unlawful, infringing, or abusive content; (e) buy, sell, or transfer accounts or in-game items for real value outside features we provide; or (f) use the Service to violate any law. We may remove content and take action on violations.
The Service may include virtual goods and virtual currency (for example, Supplies and Flares). These have no monetary value, are not your property, and are licensed — not sold — to you for use within the Service only. They cannot be redeemed for cash and cannot be transferred except through features we provide. We may change, limit, or remove virtual items and currency, and may adjust game balance, at any time. If and when purchases are offered, they are processed by third-party payment providers and are subject to their terms; except where required by law, all purchases are final and non-refundable. Auto-renewing subscriptions, if offered, will disclose their price and renewal terms at purchase and may be cancelled as described at that time.
You retain ownership of content you submit (such as a display name or faction name). You grant us a worldwide, royalty-free license to host, display, and use it to operate the Service. You are responsible for your content and represent that you have the rights to submit it.
The Service and all associated software, art, text, and trademarks are owned by DEADZONE DOMINION or its licensors and are protected by law. DEADZONE DOMINION is original work; genre references do not imply affiliation with any third party.
The Service is provided as an ongoing online game. We may add, change, suspend, or discontinue features, wipe test data during development, perform maintenance, or shut down the Service, at any time. We are not liable for any loss of progress, virtual items, or currency resulting from these actions except as required by law.
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEADZONE DOMINION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold DEADZONE DOMINION harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or the law.
Please read carefully — this affects how disputes are resolved. Except for small-claims matters and requests for injunctive relief, you and DEADZONE DOMINION agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration, administered under the rules of a recognized arbitration provider, seated in Florida, and not in court. You and DEADZONE DOMINION waive any right to a jury trial and to participate in a class, collective, or representative action; disputes will be arbitrated only on an individual basis. If the class-action waiver is found unenforceable, the remainder of this section will not apply to that dispute. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with your account email and the words "arbitration opt-out."
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Subject to Section 13, the state and federal courts located in Florida have exclusive jurisdiction over any matter not subject to arbitration.
We may update these Terms. If we make material changes we will provide reasonable notice (for example, in-game or by email). Continued use after changes take effect means you accept the updated Terms.
These Terms, with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them. Notices to you may be given in-game or by email; notices to us go to [email protected]. You consent to electronic communications and agree that electronic records satisfy any legal requirement that communications be in writing.
